Description:
We are seeking a skilled and detail-oriented Trademark Associate to join our Legal team. The ideal candidate will have a strong background in intellectual property (IP) law, particularly in trademark prosecution, enforcement, and litigation. He/she will be responsible for managing trademark portfolios, conducting legal research, advising clients on brand protection strategies, and handling trademark disputes.
Key Responsibilities:
- Trademark Prosecution & Registration: Conduct trademark availability searches and provide risk assessments. Draft, file, and manage trademark applications with relevant authorities (e.g., USPTO, EUIPO, IP India, WIPO). Handle office actions, oppositions, and responses to refusals.
- Trademark Enforcement & Litigation: Monitor trademark infringements and take appropriate legal action. Draft cease-and-desist letters, settlement agreements, and legal notices. Assist in trademark litigation, including preparing pleadings and evidence.
- Brand Protection & Strategy: Advise clients on brand management and protection strategies. Develop and implement anti-counterfeiting strategies. Handle domain name disputes and online infringement issues.
- Legal Research & Compliance: Stay updated on changes in trademark laws and global IP regulations. Conduct legal research and draft memoranda on trademark-related issues. Ensure compliance with international trademark laws and treaties.
Skills and Qualifications:
- Hold a Bachelor’s or Master’s degree in Law, LLB or LLM.
- Possess a valid license to practice law.
- Minimum of 5 years’ experience practicing trademark law, with a strong focus on trademark registration, prosecution, litigation, and enforcement.
- Experience in drafting, negotiating, and enforcing complex legal agreements, including licensing contracts.
- Strong legal research, negotiation, and drafting skills.
- Experience with managing global trademark portfolios.
- Strong knowledge of international trademark laws and procedures.
- Experience with trademark search, tools, databases, and filing systems.
- Proven track record in managing trademark portfolios and enforcing rights.
- Familiarity with emerging areas of IP law, such as domain names and social media trademarks.
- Excellent written and verbal communication skills.
- Ability to work independently and collaborate with cross-functional teams.
